Please read these Terms of Use ("Terms") carefully before using the website operated by C-Plane Technologies LLC (also referred to as "us", "we", or "our") for the Bortle 1 store ("the Service").

By placing an order through the Service, you warrant that you are legally capable of entering into binding contracts. You also agree that all information you provide to us for the purpose of purchasing our products is current, correct, and complete.

  • Print-on-Demand (POD) Model: You acknowledge that our products are made-to-order using a Print-on-Demand (POD) model. This means items are custom-produced specifically for you after you place an order, which is why returns are generally limited.

  • Pricing: All prices listed for products are subject to change without notice.

  • Accuracy: We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

4. Shipping and Returns

Your purchase is also governed by our Shipping Policy and Return and Refund Policy, which are incorporated into these Terms by reference. You agree to those policies by using the Service.

5. Intellectual Property

The Service and its original content, features, and functionality (including all designs, logos, text, graphics, and product designs) are and will remain the exclusive property of C-Plane Technologies LLC. This includes the Store's distinctive Trade Dress related to the consistent use of animal silhouettes, dark sky backgrounds, and unique color palettes on our merchandise. You may not use any of this intellectual property without our express written permission.

6. User Conduct and Prohibitions

You agree not to use the Service for any unlawful purpose or to:

  • Harass, abuse, insult, or defame others.

  • Infringe upon our intellectual property rights or the intellectual property rights of others.

  • Submit false or misleading information.

  • Transmit any viruses or any other type of malicious code.

In no event shall C-Plane Technologies LLC, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access to or use of our servers and/or any and all personal information stored therein; (iii) any product procured from the Service.

These Terms shall be governed and construed in accordance with the laws of Nevada, without regard to its conflict of law provisions.
